1. ABOUT THESE TERMS
1.1 These Terms apply to the remote gambling services supplied by Strike6 Ltd through strike6.co.uk, play.strike6.co.uk, thesweep.co, associated mobile applications and any other domain expressly identified as operated under Gambling Commission account 100125 (the Services).
1.2 The agreement between you and Strike6 consists of these Terms, the Product Rules displayed for the relevant lottery or pool, any promotion terms that apply to you, and the Privacy Notice. The Privacy Notice explains data processing and does not remove any legal right.
1.3 Product Rules apply only to the relevant product. Promotion terms apply only to the relevant promotion. Neither may remove your statutory rights or contradict the customer protections in these Terms. If provisions conflict, the interpretation that is lawful, fair and most favourable to you will apply unless a mandatory legal requirement dictates otherwise.
1.4 You must be given a reasonable opportunity to read and accept these Terms before gambling. We will provide a durable copy or a means for you to save or print them.
1.5 Free-to-play products that do not legally constitute gambling will be identified as such. Unless expressly stated, participation in a free-to-play product does not qualify a person for a paid lottery or pool prize.
2. ABOUT STRIKE6 AND ITS LICENCE
2.1 The Services are provided by Strike6 Ltd, registered in England and Wales under company number 08835055, with registered office at 8 St Andrews Street, Biggleswade, Bedfordshire, England, SG18 8BA.
2.2 Strike6 is licensed and regulated by the Gambling Commission. Its account number is 100125 and its remote operating licence reference is 100125-R-342211-002. The public register records active permissions for Society Lottery, Pool Betting and Linked Gambling Software.
2.3 Strike6 will identify the legal classification of each product before you participate. A society lottery will be described as a lottery. A pool-betting product will be described as pool betting. Lottery and pool terminology are not interchangeable.
2.4 For each society lottery, the information shown before purchase and on the electronic ticket will identify the promoting society, charitable or non-commercial purpose, ticket price, draw, prize allocation and how proceeds are used. Where Strike6 promotes a lottery in its own capacity as the licensed society, that will be stated clearly.
2.5 Gambling provided to customers in Great Britain is supplied in reliance on Strike6’s Gambling Commission licence.
3. ELIGIBILITY AND REGISTRATION
3.1 You may register and gamble only if you are at least 18 years old, are acting for yourself, are physically located in Great Britain when gambling, are legally capable of entering a contract, and are not self-excluded from the relevant Services.
3.2 Underage gambling is an offence. We will not accept an entry or pool bet until the age and identity checks required for that product have been completed. We may apply an 18+ limit even where a lower statutory age could otherwise apply to a particular lottery.
3.3 You must provide accurate, complete and current information, including your legal name, date of birth, residential address, email address and any reasonably required verification information. Tell us promptly if it changes.
3.4 You may hold only one account. We will use proportionate systems to identify duplicate accounts. An accidental duplicate will not by itself permit us to confiscate legitimate funds.
3.5 You must not register or gamble for another person, allow another person to use your account, or use a payment method you are not authorised to use.
3.6 We may refuse registration on reasonable legal, regulatory, safer-gambling, fraud-prevention, security or commercial grounds. Where lawful and appropriate, we will provide a general explanation.
4. VERIFICATION AND FINANCIAL CRIME CHECKS
4.1 We will verify age and identity before permitting gambling where required. We may use reliable electronic sources and may request documents such as photographic identification, proof of address, proof of payment-method ownership, source of funds or source of wealth.
4.2 Requests will be reasonable and proportionate to the risk and regulatory purpose. We will explain what is required, how to provide it and, where practicable, the expected review time.
4.3 We may temporarily restrict deposits, gambling or withdrawals while reasonably necessary checks are completed. We will not use verification as a means of delaying a withdrawal where we could reasonably have requested the information earlier.
4.4 If checks cannot be completed, we may suspend or close the account. We will return legitimate deposits and winnings not affected by fraud, unlawful conduct or a legal prohibition. We may delay or decline to explain an action where the law prevents disclosure.
4.5 We may report suspicious or unlawful activity and provide information to the Gambling Commission, law-enforcement bodies, sports governing bodies, payment providers or other authorised recipients where lawful.
5. ACCOUNT SECURITY
5.1 Keep login details secure, use reasonable device security and notify support@strike6.co.uk immediately if you suspect unauthorised access.
5.2 You are responsible for transactions you authorise or cause. You are not responsible for loss caused by Strike6’s breach of contract, negligence, security failure or breach of law.
5.3 We may secure or suspend an account where we reasonably suspect compromise. We will investigate promptly and restore access or close the account as appropriate.
6. DEPOSITS AND PAYMENT METHODS
6.1 Available deposit methods, limits and any charges will be shown before you confirm a payment. The standard minimum deposit is £5 unless the payment screen states a lower amount.
6.2 We do not accept credit cards for gambling, including credit-card funded payments made through an e-wallet or other money-service business.
6.3 Deposits must be made from a payment method you own or are legally authorised to use. Funds must not derive from crime or be used for unlawful activity.
6.4 A deposit is not a fee for withdrawal. You may withdraw available cash funds without first gambling them, subject to proportionate verification and financial-crime controls.
6.5 We may reject a payment method or transaction for reasonable security, legal, regulatory, technical or commercial reasons. We will not retrospectively disadvantage an accepted entry solely because we later stop supporting a payment method.
6.6 If a chargeback or reversal is validly made against your account, we may recover the amount and reasonable direct costs, but only after giving you information sufficient to understand and challenge the adjustment.
7. CUSTOMER FUNDS AND INSOLVENCY
7.1 Customer funds are held in a bank account separate from Strike6’s company funds in accordance with licence condition 4.1.1.
7.2 Customer funds are not protected in the event of insolvency: not protected - segregation. This means customer funds are kept separate from company funds, but they would form part of the assets of the business if Strike6 became insolvent and may not be recoverable.
7.3 Before you first use deposited funds to gamble, we will require you to acknowledge this disclosure. We will repeat the disclosure after a material change. Where required for the relevant lottery type, we will remind you at least every six months, state the balance held for you and obtain acknowledgement before further gambling.
7.4 Funds do not earn interest. A balance shown in the account is evidence of the balance but is not conclusive and may be challenged through our complaints process.
8. WITHDRAWALS
8.1 You may withdraw available cash funds at any time. A balance below the normal £5 minimum may be withdrawn in full by contacting Customer Support.
8.2 We normally return funds through the original payment route. Where that is not possible, we may use another verified payment method in your name.
8.3 We will process an approved withdrawal without undue delay. Timing after release depends on the payment provider. Any estimated timeframe displayed to you is an estimate, not a waiver of our duty to act promptly.
8.4 We may delay a withdrawal only while reasonably necessary to complete a proportionate legal, regulatory, security or fraud investigation. We will not require you to gamble deposited money before withdrawal.
8.5 We may cancel a pending withdrawal at your request only where this is consistent with safer-gambling controls. We will not encourage you to reverse a withdrawal in order to gamble.
9. LOTTERY PARTICIPATION
9.1 Before purchase, the applicable Lottery Rules and purchase screen will clearly show the ticket price, closing time, draw date or determination method, available prizes, how prizes are allocated, the likelihood of winning or how it is calculated, any rollover or tie rules, claim arrangements and how proceeds are used.
9.2 A lottery entry is accepted only when payment is successfully completed and an electronic confirmation or ticket is issued. The ticket will contain the information required by law and the licence, including that the lottery is licensed by the Gambling Commission and details of the Commission’s website.
9.3 Entries cannot ordinarily be changed or cancelled after acceptance, except where the Lottery Rules allow it or where required by law. This does not affect remedies for an unauthorised or incorrectly processed transaction.
9.4 Each lottery will be conducted and determined in accordance with the filed Lottery Rules. Amendments will not apply retrospectively to an entry already purchased.
9.5 At least 20% of the proceeds of each society lottery will be applied to the relevant non-commercial purpose. The promoting society and purpose will be displayed before purchase.
9.6 Product-specific prize limits, ticket limits and allocation rules will be stated in the Lottery Rules. No generic account-level cap will reduce a prize properly payable under those Rules.
9.7 Prize results and relevant records maintained by Strike6 are evidence of the result but are not immune from challenge. You may use the complaints and ADR process.
10. POOL BETTING PARTICIPATION
10.1 Before placing a pool bet, the Pool Rules and bet confirmation screen will show the event or virtual event, selection, stake, closing time, basis on which the pool and deductions are calculated, dead-heat or tie treatment, void rules and method of allocating dividends or prizes.
10.2 A pool bet is accepted only when sufficient cleared funds are available and you receive confirmation. A request, pending message or deduction without confirmation does not by itself prove acceptance.
10.3 Returns depend on the relevant pool and successful selections and are not fixed odds unless expressly stated. Deductions and the distribution method will be disclosed in the Pool Rules.
10.4 We may reject a proposed bet before acceptance on reasonable legal, regulatory, integrity, safer-gambling, risk or technical grounds. An accepted bet remains valid unless a specific fair and transparent Rule permits voiding.
10.5 Where a virtual event uses linked gambling software, the result will be generated and recorded in accordance with applicable remote technical standards and testing requirements.
11. RESULTS, PRIZES AND SETTLEMENT
11.1 We will credit correctly calculated prizes or returns as soon as reasonably practicable after determination and any necessary validation.
11.2 If a result is corrected by the official source or an event is lawfully resettled, we may correct settlement in accordance with the applicable Product Rules. We will explain any account adjustment.
11.3 A prize or return will not be withheld merely because you exercise a statutory right, complain, self-exclude after the relevant entry was accepted, or decline marketing.
11.4 You should notify us promptly if you believe settlement is wrong. Delay does not automatically extinguish a valid claim, although it may affect the evidence reasonably available.
12. ERRORS, INTERRUPTIONS AND VOIDS
12.1 A Material Error means an objectively verifiable error in price, pool calculation, result, display, acceptance or settlement that materially changes the transaction and which a reasonable customer would recognise as an error, or which makes performance impossible or unlawful.
12.2 We will correct a Material Error fairly and, so far as possible, place you in the position that would have applied without it. Depending on the circumstances, this may involve correction, resettlement, voiding and return of the stake.
12.3 We will not void an entry or bet merely because of an internal mistake that did not materially affect it or that you could not reasonably have recognised, unless performance would be unlawful or impossible.
12.4 If money was credited because of a clear Material Error, we may reverse the erroneous credit after explaining the adjustment. We will not withhold unrelated deposits or winnings.
12.5 Temporary interruption, device speed or communication failure does not create an accepted transaction without confirmation. Nothing in this clause excludes liability that cannot lawfully be excluded.
13. PROHIBITED CONDUCT
13.1 You must not commit fraud or money laundering; cheat or collude; manipulate a product or result; misuse inside information; use unauthorised automated tools; exploit a known fault; disguise your identity or location; use another person’s account or payment method without authority; threaten staff or customers; or otherwise commit a deliberate material breach.
13.2 A breach is material where it causes or risks significant harm to Strike6, another customer, the integrity of gambling, a licensing objective or compliance with law.
13.3 We may investigate suspected prohibited conduct and take proportionate action. We will distinguish deliberate abuse from an innocent mistake and consider the evidence, seriousness, connection to affected transactions and customer vulnerability.
13.4 Where misconduct is substantiated, we may void only affected entries or bets, recover the directly connected financial advantage, restrict services, suspend or close the account and report the matter where lawful.
13.5 Legitimate deposits, prizes and returns unrelated to the breach will be paid unless retention is required or permitted by law. Any recovery from you is limited to reasonably foreseeable direct loss caused by your deliberate or fraudulent material breach and proved by Strike6.
14. SAFER GAMBLING
14.1 Gambling involves a risk of loss. We make information readily available about safer gambling, account tools, spending controls, time-outs, self-exclusion and independent support.
14.2 The controls currently available in your account are: daily, weekly and monthly deposit limits. A decrease to a deposit limit takes effect immediately. An increase or removal takes effect only after the displayed cooling-off period and your further confirmation. Self-exclusion is available immediately through Profile > Responsible Gambling or Customer Support.
14.3 We monitor activity as required for the relevant product and may interact with you, request information, impose limits, restrict products, suspend gambling or close the account where appropriate to reduce risk of harm.
14.4 Safer-gambling action will be taken fairly. We may stop future promotional access where appropriate but will not confiscate an earned benefit or legitimate balance merely because safer-gambling indicators are identified.
14.5 Independent support is available from GamCare at www.gamcare.org.uk and by telephone on 0808 8020 133 in England and Scotland or 0808 2819 265 in Wales.
15. TIME-OUT AND SELF-EXCLUSION
15.1 Where applicable to the product, you may take a time-out through your account for the periods displayed. During a time-out you cannot gamble, but may withdraw available funds and contact support.
15.2 You may self-exclude immediately through the automated account process or by contacting support@strike6.co.uk. We offer six months, one year and five years.
15.3 When self-exclusion is applied, we will close your gambling account, take all reasonable steps to prevent further gambling, return available funds subject to lawful checks, stop direct gambling marketing as soon as practicable, and signpost counselling and support.
15.4 Self-exclusion applies to relevant Strike6 accounts and gambling brands covered by our system. We will retain sufficient information to operate the exclusion and identify attempts to circumvent it.
15.5 Where Strike6 is required to participate in GAMSTOP for a product, or participates voluntarily, the applicable GAMSTOP exclusion will be implemented in accordance with scheme requirements. Register at www.gamstop.co.uk using accurate matching personal details.
15.6 Your account will not automatically reopen when the selected period expires. Any return request must be made positively through the channel we specify and is subject to at least a one-day cooling-off period and applicable self-exclusion rules. Marketing will not restart without fresh valid consent.
15.7 Nothing in these Terms transfers Strike6’s regulatory responsibilities to you or excludes liability arising from our failure to take required self-exclusion steps.
16. PROMOTIONS, REWARDS AND BONUSES
16.1 Each promotion will have separate terms that are clear, fair and readily accessible for its full duration. Significant conditions will be shown prominently at the point of offer and, for online advertising, no more than one click away.
16.2 Significant conditions include eligibility, qualifying activity or spend, maximum benefit, expiry, withdrawal effect, excluded products, geographic limits and any wagering requirement.
16.3 A wagering requirement will not exceed 10 times the bonus funds. An incentive will not combine more than one gambling product type.
16.4 We will not alter the amount or value of an incentive because qualifying activity was completed faster than the period offered.
16.5 Once you have completed qualifying activity, we will not impose a new restriction that prevents receipt or fair use of the earned benefit, except where necessary for substantiated fraud, illegality or immediate protection from gambling harm and only with fair financial treatment.
16.6 We may restrict future promotion eligibility on reasonable grounds disclosed in the promotion terms. We will not describe a paid stake as “free”.
17. SUSPENSION AND ACCOUNT CLOSURE
17.1 You may close your account at any time through the account interface or by emailing support@strike6.co.uk. We will pay available funds and honour accepted entries and bets unless another fair term or the law permits a different result.
17.2 We may suspend or close an account on reasonable legal, regulatory, safer-gambling, security, integrity, fraud, material-breach or genuine commercial grounds.
17.3 During an investigation, restrictions will be no wider or longer than reasonably necessary. We will investigate promptly and provide information about the nature and expected progress where lawful.
17.4 On closure, we will return legitimate available funds and pay valid prizes or returns not affected by the reason for closure, unless legally prohibited.
17.5 If we discontinue a product or close an account for a commercial reason unrelated to your conduct, we will give reasonable notice where practicable and will not cancel an accepted entry or bet unfairly.
18. DORMANT ACCOUNTS
18.1 An account may be treated as dormant after at least 12 consecutive months without login, deposit, withdrawal or gambling activity.
18.2 Before closure, we will take reasonable steps to contact you and return the balance through a verified payment route. We do not charge a dormant-account fee.
18.3 Unclaimed funds remain payable to the lawful customer, subject to identity verification and any applicable legal limitation period or lawful treatment of unclaimed balances.
19. CHANGES TO THESE TERMS
19.1 We may change these Terms where reasonably necessary to reflect law, regulation, licence requirements, binding guidance, security, technology, payment arrangements or material changes to the Services.
19.2 We will notify you of a material change before it takes effect, explain the change and state its effective date. We will not treat silence alone as acceptance where affirmative consent is required by law.
19.3 A change will not retrospectively alter an accepted entry, bet, prize or earned promotion unless required by law or necessary to correct a Material Error fairly.
19.4 If you do not accept a material change, you may close your account and withdraw available funds without penalty. We will retain prior versions and make them available on request.
19.5 Changes to lottery rules will be filed with the Gambling Commission within the applicable notice period before amended tickets are offered.
20. PRIVACY AND COMMUNICATIONS
20.1 We process personal data as explained in the Privacy Notice at https://strike6.co.uk/privacy-policy and in accordance with applicable data-protection law.
20.2 Service messages necessary to administer your account, transactions, safer gambling, security or legal obligations are not marketing.
20.3 We will send direct electronic marketing only with informed, specific consent or where expressly permitted by law. Every marketing message will offer an appropriate way to withdraw consent. Withdrawal will be actioned as soon as practicable.
20.4 We may retain and disclose information where reasonably necessary for legal, regulatory, fraud, integrity, complaints and dispute-resolution purposes.
21. LIABILITY
21.1 Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation; death or personal injury caused by negligence; breach of statutory rights; failure to pay a valid prize or return; or any liability that cannot lawfully be excluded or limited.
21.2 Strike6 is responsible for loss or damage that is a reasonably foreseeable result of our breach of contract or failure to use reasonable care and skill.
21.3 We are not responsible for loss caused solely by an event genuinely outside our reasonable control where we took reasonable steps to prevent or reduce its effect. We remain responsible for matters within our control, including our selection and oversight of service providers where the law so requires.
21.4 The Services are supplied for personal, non-commercial use. We are not responsible for business losses that were not reasonably foreseeable in a consumer relationship.
21.5 Any limitation will be interpreted narrowly and will not reduce a remedy available under consumer law or the LCCP.
22. INTELLECTUAL PROPERTY AND ACCEPTABLE USE
22.1 Strike6 and its licensors own the intellectual property in the Services. You receive a limited, revocable, non-transferable right to use the Services personally and lawfully.
22.2 You may not copy, scrape, reverse engineer, disrupt, commercially exploit or introduce malicious code into the Services except where the law expressly permits it.
22.3 This clause does not prevent you from keeping copies of contractual information, transaction records or evidence reasonably needed for a complaint, legal claim or exercise of a statutory right.
23. COMPLAINTS AND DISPUTES
23.1 Complaints are free. Email support@strike6.co.uk with your name, registered contact details, relevant transaction or draw, date and a clear description. We will acknowledge, investigate fairly and keep you informed.
23.2 Our complaints procedure is available through the Website and explains acknowledgement targets, investigation stages, response times and internal escalation. You should complain promptly, but an otherwise valid complaint is not automatically barred merely because it was submitted more than six months after the event.
23.3 If we cannot resolve a gambling dispute to your satisfaction within eight weeks of receiving it, or we issue a final deadlock letter earlier, you may refer it free of charge to the Independent Betting Adjudication Service (IBAS), subject to its remit.
23.4 IBAS: www.ibas-uk.com; adjudication@ibas-uk.co.uk; +44 (0)20 7347 5883; PO Box 62639, London EC3P 3AS. Referral should be made within the period stated by IBAS and normally within 12 months of our final response.
23.5 ADR does not restrict your right to bring proceedings in any court of competent jurisdiction. A resolution agreed by you with ADR assistance may be binding where you expressly agree.
23.6 Account and system records are evidence, not the final authority. You may challenge them through the complaints procedure, ADR or a competent court.
24. GENERAL LEGAL PROVISIONS
24.1 These Terms and the Agreement are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts that have jurisdiction where you live. Mandatory consumer rights in your place of residence are unaffected.
24.2 We may transfer the Agreement only where this does not reduce your rights or guarantees. We will notify you before a material transfer. You may not transfer your account.
24.3 If a provision is invalid or unenforceable, the remaining provisions continue. Delay in exercising a right is not a waiver.
24.4 These Terms do not give enforcement rights to anyone other than you and Strike6, except where legislation provides otherwise.
24.5 English is the governing language. If we market in another language, we will make relevant safer-gambling information, player guides and the key contractual summary available in that language. Any discrepancy will be resolved consistently with consumer fairness.
24.6 Headings and summaries assist navigation and do not limit your rights.
